This past Friday, Bernard Ntaganda was sentenced to four years in a Rwandan prison, marking the second time in the past year that a former presidential candidate has been sent to jail. The verdict underscores severe corruption problems within President Paul Kagame’s administration. Though revered by many, the former general who brought Rwanda out of her darkest hour has since ruled the central African nation with an iron fist. While the country has made great strides in reconciling the internecine strife between the Hutu and Tutsi peoples, the future for the country appears bleak if President Kagame is allowed to continue to bully his opposition into political irrelevancy. It’s high time for the Kagame administration to change course, and adopt a greater degree of political openness — indeed, an about face may be the only thing that can put Rwanda back on the right path.
Three summers ago, I spent a month traveling around Rwanda, volunteering at a number of different hospitals and health clinics. Thanks to the ubiquity of English across the country, I was able to connect with many Rwandans on a substantive level. Our conversations ran the gamut from food to family to football (their version). But there seemed to be a palpable aversion to discussing what was most directly on my mind — the genocide. Rwandans are, by and large, an astoundingly gregarious people. Yet, without fail, conversation became terse when the topic turned to 1994. It was almost as though, in an effort to expedite the reconciliation process, now 17 years in the making, it was nationally understood that the less one discussed the genocide, the greater the chance it would be forgotten. My travel companions and I noticed that the country had taken the phrase “never forget” and turned it on its head — in Rwanda, it was, more appropriately, “forget ASAP.”
Throughout the trip, two things continued to fascinate me — the speed and success of the genocide reconciliation process, and the reverence that so many citizens paid to President Paul Kagame. The admiration, bordering on idolatry, was appropriate; the man was the greatest war hero the country had ever known. I thought of him as a modern day George Washington. But unlike our founding father, Kagame did not forfeit the sword upon taking political office. He won the trust of his citizens, but has maintained and fortified said trust by thuggish intimidation, not political benevolence. Paul Kagame has spent the last decade fortifying his regime through strong-arming, violence and chicanery. Supposed political transparency and freedom of speech in Rwanda are both shams. Though I do actually believe that those who support Kagame do so for legitimate, laudable reasons, I cannot condone the practices that Kagame and his thugs employ to silence any semblance of opposition. Ntaganda and the others imprisoned are, if you can believe it, the lucky ones. This past July, Gakwe Rwisereka, the Vice President of the opposition Green Party, was found decapitated on the Rwandan-Burundi border.
Though one can argue that strong leadership was essential for bringing Rwandans out of the bloodshed that resulted in the death of some 850,000 victims, business as usual is not sustainable. One need only look to the northern coast of the African continent to see what can happen when scores of people become dissatisfied with years of authoritarian rule. If Paul Kagame wants to avoid the same fate of Hosni Mubarak, he would be prudent to welcome in dissenting voices, not send thugs to shut them up. It’s time for Paul Kagame to open up, unclench his fist and accept the voices and demands of political opposition. Only then will the country truly move past its horrific past.

MR. FRANK HABINEZA FINALLY LEAVES THE OPPOSITION COUNCIL WHEN MS. VICTOIRE INGABIRE TRIAL IS OPENING (28.12.10)

Today, in a long waited Declaration Of The Democratic Green Party of Rwanda, Mr. Frank HABINEZA's party left the Permanent Consultative Council of the opposition parties in Rwanda-PCC.
Today, after Ms. Victoire INGABIRE's lawyer introduced yesterday a request for immediate release because of illegal detention after the expiration of the second 30-day preventive detention, the National Prosecution Authority has petitioned the High Court for the evidential stage of the trial. The defendant has not yet been informed about the official charges pressed against her.
Tomorrow 08:00 AM, the Intermediate Court of GASABO is hearing the lawyer's petition for immediate release. There is no doubt that this is another Prosecutor's trap to fool the Court that the case is already ready for trial in order to maintain Madame Victoire INGABIRE in prison.
The FDU-INKINGI party takes good note of Mr. HABINEZA's painful decision after many months of swings, panic, endless agony and unpredictable political position. This is a relief for all. Knowing the Machiavellian nature of the ruling party RPF and the never honoured iron-and-stick deals, we remain sceptical about this new marriage of convenience. This is the irony of a hunting predator, stalking his prey, waiting for one to go astray and be separated. We are always open to work with all those fighting for democracy, the rule of law, justice and a lasting solution to the Rwandan crisis. Though, Mr. Frank HABINEZA abandons his two co-founders of the PCC in maximum prison for politically motivated charges, we remain proud of what we have achieved together since the creation of the PCC in February 2010. The history will always remember our colleagues who were assassinated, like the late André KAGWA RWISEREKA, his Vice President, and we remain indebted to those courageously enduring the fist of the dictatorship and particularly those in detention like Ms. Victoire INGABIRE UMUHOZA, the Chair of FDU-INKINGI, and Mr. Bernard NTAGANDA, the Founding President of PS IMBERAKURI, or other democracy martyrs.

THE POLITICALLY MOTIVATED DETENTION OF VICTOIRE INGABIRE STILL GOING ON.

TODAY IS HER 7th DAY IN JAIL.

The health status of Ms. Victoire INGABIRE, FDU-INKINGI Chair, is still worrying. She was again seen by a police paramedic this morning who provided some medications.

The confrontation with the state-prepared key witness took place in GASABO COURT HOUSE  between 14:30 and 18:00. From contradictions to contradictions, the key witness, Major Vital UWUMUREMYI, is pleading guilty, begging for mercy and forgiveness and volunteering all the information used by the Prosecutor to keep Ms. Victoire INGABIRE in jail.
The witness revealed that he has been using many  identities and passports but has been continuously  living in Rwanda since early 2009. The police information that he was arrested alongside the DRC common border with documents and evidence involving Ms. Victoire INGABIRE in a terrorist ploy is just fake. In normal circumstances, a person with multiple identities is not reliable in Rwandan courts.  How can a government rely on only one witness with questionable credibility?

The article 59 of the code of criminal procedure stipulates : “Persons against whom the prosecution has evidence to suspect that they were involved in the commission of an offence cannot be heard as witnesses”. (LAW N° 13/2004 OF 17/5/2004 RELATING TO THE CODE OF CRIMINAL PROCEDURE, O.G SPECIAL Nº OF 30/07/2004).

There is no clear information on the bail hearing despite the fact that the lawyer submitted a formal request  since the arrest.

This is clearly a politically motivated trial and there will be no relief unless serious pressure is maintained on General Paul KAGAME. He seems to be the only person to decide in this case. We remind that since the previously granted bail in April 2010, the opposition leader has never been a flight risk nor a threat to the community. We call again for a medical parole without any further delay.

Your Excellencies,
The Permanent Consultative Council of Opposition Parties in Rwanda which brings together, the United Democratic Forces (FDU–Inkingi), the Democratic Green Party of Rwanda and the Social Party IMBERAKURI strongly calls for an urgent intervention of the United Nations Security Council in the Rwandan Political crisis.
The Rwandan Opposition is convinced that your urgent intervention will help defuse the current political crisis in the country and help achieve sustainable peace in the Great Lakes Region of Africa.
Excellencies, as you may be aware, all the three genuine opposition political parties that have challenged the RPF Led Rwandan Government have undergone serious and dangerous trials both in 2009 and 2010. They were all blocked from participating in the recently concluded Presidential elections, which the incumbent run with stooge candidates and later awarded himself 93%.
The Government refused to register the Democratic Green Party of Rwanda after a whole year of risky peaceful struggle that was started on 14th August 2009. Its Vice President Andre KAGWA RWISEREKA was assassinated and found decapitated on 14th July 2010, till now those killers have not faced justice and there are no signs of on-going investigations despite the fact that the UN Secretary General, EU, Government of France and Government of Canada called for investigations.
The Government of Rwanda also refused to register the United Democratic Forces-FDU Inkingi and many of its members have been imprisoned or released on bail. On 14th October 2010, Ms. Victoire INGABIRE UMUHOZA, FDU Inkingi Leader was arrested and incarcerated in KICUKIRO police custody on politically motivated charges of forming a not-yet known terrorist organization (Coalition of Democratic Forces - CDF as an alleged military wing of FDU-Inkingi). The conditions of her detention are cruel and inhumane : she is day and night in handcuffs and denied any sleeping item.
In April 2010 she was bailed out of jail and kept since then under extended house arrest. She had never been given a chance to defend herself in a court of law and now new politically motivated
charges have surfaced. We are strongly convinced that this was a Government Plan to bar her from competing in the past Presidential elections. We are very concerned that she may be treated and incapacitated like the former Head of State, Mr. Pasteur BIZIMUNGU. We call for her immediate release from Prison.
The Social Party Imberakuri had managed to get registered in July 2009 after several failures and beatings, but was later broken up into several factions, one of them now in the Government’s Political Parties Forum. Its Founding President, Maître Bernard NTAGANDA is in prison since 24th June 2010, he is in critical healthy conditions and had been admitted at King Faycal Hospital last week, he is reported to be losing sight and to be paralyzed due to ill-treatment in the Kigali Maximum Prison known as “1930”.
The vicious cycle of political violence in Rwanda has been due to a lack of a system for a peaceful competition for and transfers of power between the political elites. We must all take a commitment to make sure that it does not happen again. Justice is needed for the country to achieve genuine reconciliation and sustainable development.
To have sustainable peace in Rwanda, there is a strong need of creating political space that enables a peaceful process of transfer and competition for power. We call for a Truth, Justice and Reconciliation Commission and a Rwandan National Dialogue.
It is quite sad that the present government has failed on many of the promises it pledged.
We have more political leaders in exile today than ever before : three former Prime Ministers, two former Speakers of Parliament, three former Ministers of Foreign Affairs, one Minister of Defence, one Minister of Justice, one Minister of Home Affairs assassinated in Nairobi, Members of Parliament (one was assassinated in Nairobi), ambassadors, military officers including (Lt.Gen. Kayumba Nyamwasa who survived an assassination attempt on 19th June 2010 in Johannesburg, South Africa), etc.
Many ordinary people are fleeing their country at a time when prominent members of the political elite are fleeing for their lives. We fear therefore that the present management of the political system has the potential to lead to another cycle of violence. This must be stopped immediately ; UN Security council can prevent this. It should not be like the 1994 Genocide.
In this respect, the members of the Permanent Consultative Council of Opposition Parties in Rwanda, decided to take part in a peaceful democratisation process of the country. We are determined to help break the cycle of fear, mistrust and impunity in Rwanda.
The Rwandan Opposition has been subjected to verbal and physical intimidation and abuse. The legal framework has been used against us to stop United Democratic Forces (FDU–Inkingi), the Democratic Green Party of Rwanda from registering our political parties and exercising our political rights. The Democratic Green Party of Rwanda’s founding convention on 30th October 2009 was sabotaged violently, by people suspected to be connected to security organs and others to be working for the Government.
An independent press has almost completely disappeared. In July 2010, Mr. Jean-Léonard RUGAMBAGE, a journalist and critic of the government, was murdered.
The papers that are critical of government have been forced to close down (UMUSESO and UMUVUGIZI Newspapers) and their owners forced to flee the country, because their lives were in danger. Both are now operating online from exile. The Government has recently lifted the suspension on these papers, but the present Media Law and National Media Council are legal tools used by the Government to control free media in the country. The Media Law need serious revision. Journalists are jailed on charges related to their freedom of expression. Other media houses exercise self-censorship in order to survive. Two Editors of UMURABYO Newspaper (Ms.Agnes UWIMANA NKUSI and Ms.Saidat MUKAKIBIBI) are in Prison. Civil society organisations are forced to take the official Government line in order to operate.
We are very convinced that only a democratic system of government and rule of law can bring durable peace and development to Rwanda and to the Great Lakes Region at large. Rwandans are capable of solving these problems without resorting to violence. We have hard enough violence.
In conclusion, we are appealing to the UN Security Council to do everything in its power to bring the Rwandan Government to respect the United Nations conventions it has signed including the UN convention on political and civil rights and the African Charter on democracy, elections and good governance.
We are convinced that the only solution in the growing social and political tension in Rwanda depend more on the resolution of the internal political problems, this is why we request you to urgently intervene in the Rwandan Political crisis.
In particular, we request you to impress upon the President of Rwanda to immediately release all political prisoners : Ms. Victoire INGABIRE UMUHOZA, Maître Bernard NTAGANDA, Mr. Deo MUSHAYIDI, Mr.Charles NTAKIRUTINKA, Ms.Seraphine MUKAMANA, Mr.Andrew MUGANWA plus many others and also allow political parties that are critical of the regime ( the Democratic Green Party of Rwanda and FDU-Inkingi) to register and exercise their full political rights and let the legally recognised leader of Social Party Imberakuri, Maître Bernard NTAGANDA, manage his party without Government interference.
