Rwanda frustrates Ingabire’s trial

Rwanda frustrates Ingabire’s trial
It’s been more than a year of pain and anguish since Rwandan opposition leader Victoire Ingabire was arrested. The first arrest was made on May 24th 2010 and she was subsequently placed under house arrest. Even without clear evidence the police detained her again on the 15th of October the same year. Now, the Rwanda prosecution having failed to give her a speedy and fair trial is turning the blame on her. The Rwandan media claims that Ingabire is responsible for delaying her own case. The cynically implied message being that Ingabire enjoys detention.

On the 24th of June, the New Times released an op-ed titled “Victoire [Ingabire] should not Rush us”. It quoted the Rwandan prosecutor, Martin Ngoga as saying, "If these countries send us the information tomorrow, then we can start the case tomorrow, if it takes longer, we will wait, but from the feedback we have received, we are sure all information will trickle in." He was being open to the fact that Rwanda did not have enough evidence against Ingabire. Yet the government continued to detain her.

Interestingly, the Rwandan government is turning around to place the blame on Ingabire. According to Sunny Ntayombwa, a New Times columnist, Ingabire wants another five months in jail. The piece which is literally aimed at mocking her, insinuates that she is enjoying staying in a Rwandan cell with “a private shower, toilet, a comfy bed and a window”; as if to suggest that Ingabire was homeless before her imprisonment.

In an interview that Radio Netherlands Worldwide held with Ingabire’s lawyers, it emerges that the trial will be postponed but not for reasons given by Rwanda. First, the lawyers accuse the prosecution for failing to consult with them when setting the trial dates. This is important because two of the lawyers are British nationals, living in Britain. Another problem has to do with translation. Yes despite the government of Rwanda’s switch from French to English, they still conduct trials in Kinyarwanda and provide no English translations. Ingabire’s lawyers do not understand Kinyarwanda and have to translate over 2000 pages.

It’s been clear since day one that the Rwandan government wants to silence Ingabire ; and they are now using the legal system to achieve that end.

Rwandan Dossier Against Kayumba and Karenzi: Part I

From our invaluable sources, AfroAmerica has obtained original copies of the dossier concocted by the Rwandan Government and sent to the South African Government and INTERPOL requesting the arrest and extradition of the exiled Rwandan General Kayumba Nyamwasa and Colonel Patrick Karegeya. In the upcoming days, AfroAmerica Network will share with our readers the content of the voluminous but extremely interesting dossier. The dossier involves the Rwandan Government and South Africa, but also other countries in the region.


In the copy pictured above, an extract of the original copy shows the Note Verbal sent by the Rwandan Ministry of Foreign Affairs to the South African High Commission in Kigali. In the subsequent documents composing the dossier, the Rwandan Government detailed the accusations of terrorism against the two former RPF high ranking military officers and the results of an alleged investigation in the grenade attacks in Kigali.


However, one wonders how the Rwandan Government writes to the South African Government but ends the letter with “renew to the High Commission of the Republic of Uganda the assurances of its highest consideration”. Is it a typo or the fact that initially the letter was to be addressed to the Republic of Uganda, where General Kayumba Nyamwasa had fled? Or is it a confirmation that Rwanda intelligence services are also targeting Rwandan political and military figures exiled in Uganda.


Further into the dossier, Martin Ngonga, the Rwandan prosecutor, writes to the Rwandan Minister of Foreign Affairs, Ms. Louise Mushikiwabo:


“The Hon. Minister of Foreign Affairs and Cooperation

Kigali-Rwanda


Dear Madam:


Re: Transmission of Request for Extradition to the Republic of South Africa


The Rwanda police and prosecution are conducting investigations regarding two Rwandan terror suspects namely: Lt. Gen. Faustin KAYUMBA NYAMWASA and former Colonel Patrick KAREGEYA both living in South Africa.

The investigations conducted so far, reveal that the two fugitives have perpetrated the recent terror attacks in Kigali.


I am pleased to forward to you the international arrest warrants and requests for extradition of the two former Rwandan military officers for onward diplomatic transmission to the judicial authorities in the Republic of South Africa requesting the said suspect arrested and extradited to Rwandan to face trial for the crimes they have committed.

We request Hon. Minister that the transmission of these documents be effected as a matter of urgency.
